View Full Version : Speeding Fine.... not fair?

Ok, heres the deal.
I was on my lunch break and i went home, and was driving back to work.
I took a left turn onto a main road, (turn left at anytime when safe). The oncoming traffic were stopped at the red lights. At the front of the traffic waiting to go was a new blue camry.
I gunned it around the corner, so that the soon to be moving oncoming traffic wouldnt be up my ass.
So i accelerated hard and to the speed limit, but enough to give me a large gap between the traffic.
I then see the blue camry come roaring up behind me, flashing there high beams. upon closer inspection, i see 2 uniformed cops holding there badges up. they come up next to me, and tell me to pull over.
I pull over, and proceed to get a speeding infringment for 80 in a 60 zone.
i ask to see the radar, however the cop says that he doesnt have a radar, so i ask how he judged my speed, and he stated that he had been doing this long enough to know i was speeding. he estimated my speed.
The car did not have flashing lights or anything. it was just a normal camry.
the camry was not trailing me or anything, as soon as the lights went green - they floored it and caught up with me. I was a fair bit ahead because they didnt get green straight after i turned onto the road.
Any advice????

Speed limits in the ACT are enforced by police patrols using radar and laser speed measuring devices, moveable speed cameras and fixed speed cameras linked to red light cameras at some intersections.
The only speed checking device onboard was his speedometer.
A police officer can check the speed of a target vehicle either by following the target vehicle (maintaining a constant distance behind the vehicle), or traveling adjacent to the vehicle.
He did not maintain a constant distance. He came straight up behind me. He was still, i was moving.
Any advice on how to write the letter of appeal?
or ADVICE IN GENERAL!?
I know if it goes to court, i will lose, because its 2 cops words against mine, and also my driving history is not the best (several previous speeding fines).
Normally if i get a fine, i take it on the chin and pay it.
But this time, i really feel like i was targeted just because my car and its appearance.
I prefer not to say what type of car i have, but its a performance sports.

Take it to court, he's just working the odds that you won't. A friend had a
similar situation where cops estimated his speed, he took it to court and
got off. My plod wasn't impressed.

Or theyll just lie and you will get shafted anyway as happened to me :)
You might get it reduced though (as did I) or even thrown out (unlikely).

You may get off.

If you had a clean record and the police no 'real' proof, you may have
escaped that one.
As you have a speeding record and probably took of like an idiot, the
Police have you over a barrel.
The Magistrate will more than likely agree with the Police, given your
track record.

So, how much smoke and rubber did you leave?

In repsonse.
1. I didnt spin wheels or drive recklessly.
2. for a valid estimate to be made, they have to maintain a constant distance. They were stopped, and i drove in front of them. its not hard to miss a camry come straight up ur ass with its high beams on.
3. Since when do they dont?
4. Im in my late 20s, I took that information from the AFP website.
5. I THOUGHT the lights were about to change, hence why i took off quickly.
6. I wasnt driving like a dickhead, ill pay the fine if its justified, and what makes my car insensible?

sorry mate, but that bit just sounds like " i have a lowered VRSS, with the seat laid back, DOOF DOOF, polished rims possibly, na certainly driving lights on, and no prick is gunna get close.
From the courts point of view-the few priors, and performance car pretty much pigeon holes ya.

Yeah i can see how it sounds like that.
But i can assure you its not.
No subs or full sik chromies.
Just a tastefully modified car. No airbrushing, no flash colours, no flash rims, so airborne wings. and def no subs! :)
but yeah, i am definately going to write a letter of appeal, but if i took it to court, i think it would be just like, "oh look, you were done for speeding only a month or so ago" - guilty - NEXT!
Well i am just going to make my letter quite clear and precise.

That is true - but they were required to follow you for 3/10ths of a mile at no greater distance than 300 yards in order
to estmate your speed!

the letter of appeal could be worth a try - and good luck, but to let you
off is to cast doubts on so much that they hold sacred, so don't get your
hopes up. Rest assured at least, previous offences are not a factor in
determining guilt.

Maybe, but if you read the guy's entire post and take his car & previous
history into consideration, he has about as much chance of getting off as I

Exactly Michael.
I would be more than happy to pay the fine and move on IF i was genuinely at fault here.
I will start with a letter, and hope that it doesnt goto court.
Also, the factor which is putting me off going to court is, if i do go, and lose, which is more of a possibility i think, you get a conviction on your permanent record (10 years).
