Why should the insurance company pay up? You are doing something illegal.
Anyone who has a crash while driving a vehicle and they're using a
non-hands-free mobile phone at the time deserves what they get.

So what?

Just like anyone else who causes an accident while committing a driving
offence. But that does not mean that another person who suffers loss is
left high and dry because the insurance cover of the driver is not
effective.

So that can be a problem when making an insurance claim.

The OP wasnt asking about the OTHER PERSON.

Have a look at what happens with a drunk driver's insurance claim.

How do you happen to know that?

That depends on the terms of the contract between the driver and their
insurer.

Generally coverage on all property damage other than your car would
likely be covered as it would be covered under 3rd party negligence (as
long as you have it, which is in all policies other than the compulsory
kind).

Whilst you were doing something illegal, you were still negligent. I
know my policy doesn't have illegal act exclusions on the negligence
stuff, just the policy on the car itself.
