Hmmm. Aust Post might not be responsible to a bomb moving thru the post.
eBay might be responsible for permitting the sale of a bomb.

Depends on how far you could push the Cooper judgement in a case I
suspect.

Short answer would be probably not.

that is so friggin stupid, i mean as if someone is going to think 'hmm i
guess i better not send this bomb to John Howard after all, that would be
illegal!' or say to the po staff 'you know i had better not sign this
because then i would be lying because the parcel does actually contain a
bomb'

i would think no they cannot be held responsible if they don't know
something is illegal eg the person selling pirated goods would not be found
out until the buyer actually receives it & recognizes it as such,
but once ebay are alerted to the fact someone is selling illegal goods they
must take action but there must be some proof of it. Also they must have
some responsibility or they would not be have any restrictions on what
people can sell such as in this link:
http://pages.ebay.com.au/help/policies/items-ov.html

If its advertised as being pirated then they will remove it from their site.

Even if it isn't advertising as pirated but is known to be pirated.

Ebay are pretty strict on what they allow and don't allow people to sell
through their services.
