View Full Version : Anyone taken a car manufacturer to the CTTT over a lemon?

Hi,
Unfortunately I have to go to the CTTT (Consumer Trade and Tenancy
Tribunal) to try and get a satisfactory outcome for an absolute Lemon that
I bought. I don't really want to go into all the details here but if
anyone has done the same and can give any advice or would like to discuss
their/my experience via e-mail I'd be very happy to hear from you.
I have various reports stating the problems with the car as well as the
service records showing past problems, but the manufacturer is essentially
saying everything that's wrong with the car is normal...obviously when it
wasn't doing these things there was something wrong with it!!?? Apparently
(and from people I've talked to) it is quite hard to be successful against
the manufacturers at the Tribunal, I am starting to understand why given
the absolute rubbish they seem able to spout with a straight face!
Once all over and done with I'll be happy to talk about it all, makes me
too angry to type out for the millionth time though!

I did, and it was a waste of time.
Some people get lucky and get a new car or a refund, others get nothing but
contempt from the car maker. The tribunal is a lucky dip but it only costs
$69 so why not give it a go.
My lemon (2003 Combo) was finally fixed and the engine problem sorted but it
took ages for Holdens incompetent service drones to work it out.
Heartland Holden are useless twats by the way, dont buy a car there.

Yeah that's what it seems like. One guy I talked to had an initial hearing
where Holden were put on notice and told to fix the car or else, then the
next 'judge' winked at the holden bloke, said 'remember your on notice'
then proceeded to dismiss everything the guy had to say and dismissed the
case. His car is as shocking as mine so don't know what the go is there!!!!
This is a holden too, you know doubt got to deal with the charming Greg?
What a cocksucker that guy is!!!!
We are halfway through the process...had the 'conciliation' meeting (what
a joke) now after this guys "expert" inspection (there is nothing wrong,
it's supposed to do that...and that...and that) we go back for a hearing.
Wait and see.

Ask them: "if it's supposed to do that, why don't you tell us in the brochures

FWIW...I recently had a run-in with Holden over a premature engine blow up.
Out of warranty & repaired by a 3rd party for $1700.
Was getting the brush off from Holden until I informed them I intended
warning other owners of my model of this common fault via a number of
popular motoring publications, & intended including Holden's responses.
Result was a phone call offering to contribute 2/3rds of my repair costs.
Grump.

In NSW this is a division of fair trading.
Also made a complaint to the ACCC but they can't do anything other than
collect complatints until such time as they get "enough" and will launch
an investigation.

Sounds about right, didn't get anything out of them untill the CTTT letter
arrived, then they made a rediculous cash offer on a trade in....
I will mention their correspondence will be published after the final
hearing, good idea.

With the rubbish holden sell I'm beginning to think they should. "Standard
Features".
