ok I know mobile phones your not supposed to use them while driving
but what about cb uhf radios? can u get busted using them, my brothers might
be putting one
in for his work van, wasnt sure...

CB radios are ok to use on the move. See rule 300. (this is for
Victoria, but most of these are national road rules.)

I'm not sure 'why' the distinction, but I believe it's because they have
a loudspeaker, hence don't have to be held to your head, and you can
still hold the microphone and the steering wheel at the same time. Also
something about them being 'asynchronous rather than 'synchronous. i.e.
you can listen, or talk, but not both at the same time.

There isn't , Ive been using ham radio for 30 years and the last time
govco tried they gave up due to the noise...

Just because that rule doesn't include CB's or two ways doesn't mean
there isn't another rule banning their use although I can't find it at
the moment.
I know people who have been fined in Vic for using two way radio's
whilst driving, that was in the 70's and I'd be surprised that the rules
have been changed.

I did find mention of the 'old' rule regarding 'use of hand held
communications equipment while driving' at this site:

from 1994. It's beginning to look like the new legislation may have
gotten it a bit wrong. The 'intent' as I read it from the above, is
that use of a hand held mobile 'phone' was meant to attract demerit
points AS WELL as a fine, while use of a two way radio would just cop a
fine.
However, the bit about the two-way radio simply does not seem to be
there anymore. (feel free to try and find it.)

fining mobile phone users they forgot about 2 way radio users:-)
I've always thought it was ridulous to be fined for using a 2 way and
I'm still not convinced that using a mobile phone (talking, not sms)
whilst driving is as evil as its made out to be.

The QLD Legislation bans the use of handheld phones and states that the
use of CB/two way comms equipment are exempt from this ban
however if it can be proven that your use of the CB/Two way was the
cause of a crash or other dangerous situation/driving you can be charged
with "Undue care and attention"

That sounds too much like common sense to be in legislation, is it
possible someone in Govco got something right?

Maybe - but as always, there's a Scam side to things.
You mean that the revenue generated from taxi operation, and the
advantages of police radio weren't a factor?

You can probably be charged under that rule for picking (or scratching,
it was only a scratch!) your nose while driving. Like several of the
road rules, it's there to give the authorities something to punish you
with when you do something quite silly, so that you don't do it again.
If we could be honest about it in the legislation, it would be called
the 'dickhead' rule.
"Your honour, the defendant was driving like a complete dickhead, so I
pulled him over and issued a citation in the hopes that he would learn
his lesson and stop driving like a complete dickhead."

Much so, you can ignore people on the other end of a CB for a minute if
necessary, but try doing that with people on a phone.
A proper car kit mobile is similar, although you can get absorbed in the
conversation a lot easier, where with a CB, you have a mini reality check
every time you press the transmit button.

I only feel safe on the phone if I'm on the freeway or a country road,
there's too much to concentrate on in city driving.

More to the point as you are being pulled up for using the two way
radio the cop whom is pulling you up is using a two way radio to get
your usuals and checking your licence and reg do you see something
forming here yep two sets of rules
I have to ask just how safe is a cop doing 190 kmh chasing someone and
using a 2 way to tell vkc just where the chase is going !!!
That is why i believe that the law excludes 2 ways from the phone law
because i dont believe it would be too hard to challenge in court !!!

It's not as simple as that
during a chase I have heard many single officer units stop chasing
because of that reason, they can't drive and call the chase
and YES the Police have a set of rules
it's called "In The Line Of Duty" or "Carrying Out Their Duty"
I'm sure you could see the major problem with having the Police car stop
in a safe place before the officer contacts VKC that they just spotted
the suspect wanted for murder/armed hold up or what ever.
the same goes for fire and ambos
so if there was a law banning the use of two way the EMS would have an
exclusion anyway, yes one law for them and one for us
I was sure that NSW had a law banning the use of two ways or CB while
driving but it was changes a year ot two ago

It is NOT illegal to use a CB radio when driving. That said, you are legally required to have full control of the vehicle at all times.
The issue was discussed late in the 1990's at length at ARR development, and so a prohibition did not come to fruition, and indeed most 'yay' argument was strong resisted.
The dynamics of this are somewhat different to that of a mobile phone. Distraction can occur if you lean down to pick up the microphone and take your eyes off the road in doing so.

You need to see my daily driver , 3 radios all on remote mike , listen
to all but only one on transmit and all hands free.

There is already an exclusion for police from the mobile phone rule, and
I believe the old rule similarly exempted the police. So it would be
quite easy for them to make it illegal for everyone except the police to
use 2-way radios if they wanted. (and it will probably only take one
horrific accident to make them ban it again.)

GovCo will do what it did for radar detectors.
It'll trawl through hundreds if not thousands of records of prangs
until it finds 'one' that justifies what they've decided to do.
might have to go back 10 years, but no matter - it's all god in GovCo
fraudlegitimizedbylegislationland.
