View Full Version : Traffic Ingringements Notice

I have an Trafiic Infringements Notice issued by NSW Police. The field
where it says, "Signature of Officer" is unsigned and left blank. The
issuing Police ooficer obivously forgot to sign.
Does this mean anything? Can I avoid paying the fine on this
technicality? :)

Functional illiteracy on the part of the cop isn't a defence? :-)
Each State has it's own regulated forms and the requirements for
what must be filled for it to be a legal document.
Without the signature, the officer would probably have to testify in
court that he filled in the form; and that would be accepted.

Yes, if there's a spelling mistake anywhere on the form, or they used the
wrong colour pen to fill it in, you don't have to pay...

So, is there a name on it at all?
If there isn't, it's gonna be difficult for GovCo to provide you with
the_right_to_face_your_accuser.
BTW, that's one of the *very_few_rights* you have at Law.,
Use it, or lose it.

If the infringment is under $200 it would be better to pay then forget
rather than paying alawer and still maybe paying the fine.

How about you ring someone like I said and maybe it would be worth it. Not
all court battles cost $2000 plus for traffic infringement. Some are pretty
simple and don't even reach court of the cop fundamentally fucked up.

My rule of thumb is never even think about doing anything until you get the
reminder. It is only when you get the reminder that you can be sure the
ticket is in the system.
On at least a couple of occassions, for what ever reaosn I have never the
received the reminder and got off. Once you receive your rmeinder, then
worry about what to do about it.
