So I book Foxtel to be installed today, Saturday 27th. I booked 3 weeks ago.
"All is fine" they said. "Body corporate has given permission" they said.
"They'll turn up between 7am to 12pm" they said. "You just pay before the
installation date" they said.
So I paid $99.95 two days ago (Thursday 25th) by credit card. I get up at
6am today, have a shower, and start waiting. At 11:00am I get a call saying
that the contractor says the building is 5 storeys high (it's only 3!) and
it can't be done. I told the guy from Foxtel on the phone that I have one
unit below me, one unit above, and that I'm in the middle -- how can that
be 5 storeys? He doesn't know. He then said they don't have body corporate
permission yet either. I said I was told they did! He then says they need
to organise a site survey before they can consider installation. I said I
was told all this was fine and I can't believe they're doing this to me.
He then starts asking what I wanted to watch! I said I'm not doing a survey
mate, I want my contract cancelled and a refund issued to my credit card. He
said they can only refund by sending me a CHEQUE in 10 business days! Is that
legal? Don't they have to refund by the same payment method? I said great,
so Foxtel gets the interest from my money in the meantime; he didn't answer.
Fucking liars. Make you think all is well, then fuck you up the arse when
the day arrives. He said he needs to recap my call and said that they will
send offers from time to time; I said DON'T SEND ME ANY MAIL, THANK YOU.
He got really shitty about that. :) He said "No need to get upset sir" and
I said "Well you guys wasted 1/4 of my weekend for absolutely nothing!".
He said thank you and ended the call.
Can I cancel my credit card payment or something, or do I need to wait for
their bullshit cheque?

Given that you want to cancel the arrangement, the only issue remaining is
how you recover the $99.95. If you can get it back by cancelling your
credit card payment or something, go ahead. But you can't.
Get them to send you a cheque ASAP, unless you have some levers to pull to
get it quicker.

I thought that was the process for refunds? It certainly is in stores...

I just rang Virgin but she said they can't cancel a payment that I authorised,
so I guess I have no choice but to wait for the cheque and be out-of-pocket
by $100 for the next two weeks.
Let this be a lesson to all: NEVER pay for something until it's done, if at
all possible. And Foxtel are BLATANT LIARS. My paperwork from them about
the install is irrefutable proof of that.

I did call, but because it was an authorised payment, I can't cancel.
And Foxtel recorded the call so I can't say it wasn't authorised. :(

Not legally, no. The payee can adopy any method of payment it finds
convenient. From your perspective, put aside your understandable
annoyance, because it gets in your way - all you need focus on (in this
exercise) is the quickest way to get your money back.

Do the Foxtel terms and conditions state that they can only refund by
cheque?
If not, you may have a case.

On the facts given, Foxtel is in breach of the contract and is prepared to
refund the $99.95. That's the normal thing, but you wouldn't understand
that.

Assuming he signed up for 24 months, they should not only charge him
the $99 installation fee, but also the monthly fee for the next 24
months. That'll teach the moron a lesson for abusing the Foxtel call
centre staff. Yeah, he's a big man abusing a lady over the phone.

Foxtel apparently recognise that it is in breach of the contract and
entitling the OP to treat the contract as at an end - it is not arguing
about refunding the $99.95. You are, but you don't count.

If the OP had gone about it in a civilized manner and didn't argue with
and abuse the poor call centre girl, he would have got his credit card
credited with the $99. Now, because of his attitude, he will have to
wait another fortnight. Someone did something similar to one of my
call centre staff once, so I arranged for his full page ad in the
yellow pages to be cancelled. He didn't know about it until the yellow
pages came out and his ad was not in. I then rang him and told him how
sad I was for him to have lost all that business over the next 12
months. Hopefully he learned a lesson in manners when dealing with
call centre staff.
