Modding Legal in Australia?

Hi, I'm sure this has come up before. I was just wondering the legality of modding Xbox or PS2 in Australia atm. Does anyone know the proper law (also have proof)
Please no secondhand news or ideas, only replys with something official.

A friend of mine used to mod the PS2 until he get a cease and desist letter from Sony, for XBOX it against their EULA, it's not legal to mod the unit, doesn't really stop you from doing it though.
