The ACA doesn't think so.

"Heya's,

3 have in the last few hours decided to voluntarily replace via
shipping to the customers preffered address all handsets without the
A-tick sticker.

A call to customer care will place you on the call back list within
48hours to organise your handset to be replaced. From what we
understand the package will include a return satchel and the
unapproved handset will need to be returned afer the replacement has
been sent.

This is currently a voluntary move by Three Australia. It may yet be
required to notify all customers of faulty handsets and have them
replaced and pay fines to the ACA.

I personally think all three customers with unapproved handsets should
take this option rather then filing further complaints, and trying to
get as much out of three as possible.

I think three should also give a certain amount of credit, to post &
pre paid customers to obtain any content they have purchased, such as
ringtones etc... that will be lost on the new handset.

Only guesses at the moment how many handsets are affected, but it is
probably in the tens of thousands...

On a personal note, i find this whole situation hillarious. How could
the second biggest mobile phone operator in the world release
thousands of illegal handsets onto the market?

It's the biggest moving 3G phone in Australia.

Well good luck with it all,

Kel"

My Mot A835 has the a-tick under the battery.
It seems to be an LG problem. Others say they lack the tick,
but maybe arn't looking hard enough.
There's an awful lot of 3 customers unhappy with their handsets and
looking for any excuse for an upgrade. I'm just glad I don't have an NEC!

That's up to ACA to decide.

Of course. My statement is still correct
