    CARe PARK

    theres car park in richmond run by CARe PARK, dunno what they are, im guessing they just do security and make sure the people who park incorrectly get fined
    well i parked there, they have a big sign saying first hour free, i was ther for 5 minutes to buy some bread from bakers delight and got slapped with a fine, apparantly i was meant to get a ticket and have it on my car displaying how long i was parked for, so my bad, i forgot to get one, anyways i sent them a letter explaining i was only there for five minutes and that my financial situation does not permit me to pay such a bill, i recieved absolutely no response at all, untill today, less than 2 months since i was fined i recieve a letter with a title
    NOTICE OF INTENT TO SUE

    a bit extreme isnt it
    please note blah blah care park ltd intends to issue proceedings against you in the magistrates court to recover $88, if you wish to avoid unnesesary cost and embarassment blah blah blah....

    umm, this letter is what i intend to send in response, ill be saving a copy just in case they do intend to take me to court, the letter is below, tell me what u guys think, if i should add/delete anything, i actually do want to say "A Bit extreme isnt it' but i dunno if i can fit that in




    Hello,
    I have just received a letter notifying me of your intention to sue in order to recover an $88 fine. I actually intend on paying this, however I did send you a letter shortly after the fine was received explaining that I was parked there for 5 minutes to buy some groceries, was unaware I needed a ticket as there is a sign saying first hour free. I further explained that I am a student and cannot afford to pay such a fine easily, I have still not yet received any reply from your office which is why the fine hasn’t been paid yet. I figured id wait for a reply before I did anything, which is what I intend to do now.
    I would like to, once again, ask that you take my financial situation into consideration and waive the fine as a once off, if possible. If not, that is okay, I will pay what is owed, but I will wait for a reply to this letter first, I hope you agree this is reasonable. If you decide not to waive the fee I will need to organize some kind of payment plan, as $88 is a lot of money, for me (it is roughly a third of my fortnightly income, take into account rent, food, petrol, etc. makes this fine quite difficult indeed). Could I propose 4 equal payments each fortnight if that is okay. Please do not threaten court proceedings, I am an honourable person and always pay my debts, I had just hoped that explaining my financial situation to you would get you to reconsider, I figured that’s why there is an ‘e’ in “CARe PARK.”

    I'd be checking to see if they have the authority to fine you in the first place, they could be just bluffing you into paying.
    Now did the fine come from the RTA, or another government dept.?

    I would visit their website and use their terminology and values in your letter in your own words, it can often be a very persuasive technique because it's hard to argue against theri own words. However, on their website they do have the following:

    Payment Notices

    You're probably visiting this page after receiving a Payment Notice or reminder letter. A Payment Notice is not a fine - but rather, is a demand for payment of liquidated damages for breach of contract. Payment Notices are securely affixed to the windscreen of a vehicle detected in breach of the contractual conditions of parking.

    As with most parking facilities, our car parks are patrolled by parking officers, whose task is to ensure that those customers who do pay for our facilities don't have to subsidise those who don't pay. They also check to ensure that only those entitled to park in disabled bays do so. It's all about ensuring fairness - to our valued customers and to our clients for whom we operate the car parks.

    Most payment notices are issued for the following breaches:

    * Failure to display a current ticket on the dashboard
    * Parking in a disabled bay without displaying a current ticket and disability permit
    * Parking in a loading zone

    All we ask of those using our car parks is for compliance with our terms and conditions! Persons to whom a Payment Notice is issued will receive a reminder if the notice remains unpaid. Beyond that, we have retained Parke Lawyers Pty Ltd to pursue unpaid Payment Notices in the courts.
    Most privatised car parks have signs as you enter saying soemthing to the effect of "by parking here you agree to our terms and conditions blah blah blah" so you may be screwed but it doesn't hurt to appeal to their good nature.

    I would send the letter along with the "Application for Review" the main corporation as well as their lawyers, http://www.pl.com.au/ who would be the ones who would have initiated legal action.

    A lot of councils in Melb sub contract their parking enforcement. So it is possible that fines are issued by private companies, on behalf of the council.

    Note: this doesn't apply to Bashes case, as his problem concerns a private car park.

    There is a carpark in Coburg that is completely free as long as u abide by the signed hour limits by the parking bays, however they still require a ticket to be posted on ur windscreen or else they will fine u. After thinking about this, confused, for a while i realised they needed the ticket to ensure ppl had infact kept to the hour limits, and it saved the council the expense of paying more inspectors to walk around chalking tyres etc.

    Id say they probably have a tiny sign somewhere that says u need a ticket.

    hope u get it sorted and they take pity on u and let u off with a warning.

    There is no reason to use sms talk in a forum. sms talk is used because sms's have a limited amount of characters. There is an (not really) infinite amount of characters for you to use to express yourself here.

    Other forum members shouldn't have to decode your every post because your either too stupid or to lazy to type properly. (i know biggy and hermit. I have spelling issues, but i have a spell checker to mitigate that issue)

    You'll notice that everyone else here doesn't type in sms talk. There is a reason.
    I would have thought the patheticness of a 24 year old talking like a 16 year old would have shamed you into realising your own stupidity.

    AND!!! who said you have the right to type as you see fit. You have no rights here. The phorums are private, not public property.

    I have a standard argument with every new f***wit that thinks they're totally awesome because they use incorrect letters to represent words only fractionally larger than their original words.

    I have gotten everyone else to type properly. (not me alone, but i was a part of it) You will be no different.

    EDIT: I suppose the whole sms thing is only now getting to Adelaide. You know the old saying... those country towns are always at least 10 years behind...

    i often feel meadows is more than 10 yrs behind. Seeing as im neither a sheep nor a fan of urs i severely doubt u will be able to get me to type in a way that pleases u. Nor will i continue to rattle on like a teenager to please ur argumentative personality.

    And back on topic i agree with femme, be careful not to get a bunch of late fees and debt collector costs on the top of the bill.
